This website (Site) is operated by Allora Jade. Throughout the site, the terms “we”, “us” and “our” refer to Allora Jade. Allora Jade offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By using the Site in any manner and/ or purchasing goods from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the Site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

These Terms also apply to the ordering, purchase and delivery of Goods from the Website and through our Customer Service Centre, and form a contract between you and Allora Jade ABN 41 035 054 352 of 1 Ormuz Ave, Caloundra Queensland 4551 Australia, as may be applicable (Terms). If you have an Allora Jade customer account, you agree that these Terms (as amended from time to time) will apply to your use of the account and all of your Orders.

These Terms contain important information about the ordering, processing and delivery of Goods, including limitation of liability. Allora Jade reserves the right in its absolute discretion at any time and without notice to amend, remove or vary the services or Terms and/or any page of this Site. Any new features or tools which are added to the current store shall also be subject to these Terms. Each time you use the Site, you should review and be aware of the current Terms. Your continued use of or access to the Site following the posting of any changes constitutes acceptance of those changes.

1. Compliance with Terms

1.1. You will be bound by these Terms each time you submit an Order.

1.2 You will be bound by these Terms each time you use or access the Site.

2. Placing Orders for Goods

2.1 By placing an Order on the Site, you are making an offer to enter into an agreement to purchase the product(s) in that order. Orders will be deemed received by Us at the time We send an order confirmation to your nominated e-mail address. It is your responsibility to ensure that the correct email address and contact details are entered with your Order.

2.2. Each Order you place will be a separate contract.

2.3. You acknowledge that all Goods purchased under these Terms are intended for personal non-commercial use only and will not be re-sold.

2.4. From time to time, We may restrict the quantity of Goods which can be purchased in one Order or during a particular period of time or per person or per address. Any quantity restrictions will be stated on the product page, or in materials about the relevant promotion, or as otherwise advised to you.

2.5. If you are purchasing using Afterpay, the maximum order value is $1,000, minimum $30 (incl GST) – inclusive of delivery charges (if applicable)

2.6. We will not be liable to you for any loss you or any third party suffers as a result of, or in connection with, a delay or failure to process your Order or deliver Goods due to inaccurate or incomplete details provided in an Order.

2.7. You agree to obtain consent to provide Us with Personal Information of recipients of gifts or Goods Ordered by you.

2.8. You may place an Order on the Site if you are aged 16 years or over (18 years if purchasing using using Afterpay), and have an active email account or a telephone number at which you can be contacted.

2.9. If you place consecutive or separate Orders, we cannot consolidate your Orders. A separate Delivery Fee, if applicable, will apply to each Order. Subject to any applicable quantity restrictions, you can order as many Goods as you wish in one Order.

2.10. We reserve the right to accept or reject your Order for any reason at any time. If We reject your Order you will receive a refund of any money paid.

2.11. Customers can checkout via a registered Account or as a guest.  

2.12. To place Orders using an Account you must be at least 18 years old and have the capacity to enter into a legally binding agreement with us.  If you are under 18, you may only place an Order with the consent and involvement of a parent or guardian.

2.13. Disposable email addresses are not permitted. If you opt to use a workplace email address for your Account or to access the Site, then you are responsible for ensuring that you comply with the rules, policies or protocols that apply to the use of your email address in your workplace.

2.14. Allora Jade may update or delete your Account information where it reasonably believes that your details are incorrect or invalid, ie email address is registered as gnail will be changed to gmail.

2.15. You are responsible for ensuring that your username and password that is used to access the Site and the details of your account are kept in a safe and secure manner. You are responsible and liable, to the extent permitted by law, for any activity on your Account including any person that uses your username and password to manage and Order through the Site.

2.16. You must not use another person’s Account without our, and/or the other person’s express permission. If you suspect or become aware of any unauthorised use of your Account or that your password is no longer secure, please contact us immediately and take immediate steps to re-secure your Account (including by changing your password to a strong password)

3. Availability of Goods

3.1. From time to time, some Goods may be out of stock or are unavailable and we may not be able to fulfil all or part of your Order. If this happens, we will refund you the price paid for the Goods impacted.

3.2. We may withdraw or suspend from sale any Good displayed on the Website, either temporarily or permanently, at any time and without notice. Allora Jade will not be liable to you for any loss you or any third party suffer as a result of a withdrawal or suspension of sale of a particular Good.

3.3. Where a Good which is the subject of an Order has been withdrawn or suspended from sale and your payment for the Good has already been processed, we will refund any money paid to us in accordance with clause 6.

3.4. Allora Jade reserves the right not to honour any incorrect offers represented on the Website made by genuine human or system error. Where your Order is affected by an error on the Website (for example, in a description, an image, Price or otherwise), We will reject that part of the Order affected by the error. You will be refunded the value of that part of your Order affected by the error, in accordance with clause 6, and we will fulfil the remainder of your Order. If you are not satisfied with the partial fulfilment of your Order, you can return your Order to us under the Returns Policy.

3.5. If your Order is affected by a genuine error (including in a description, an image or a Price), we reserve the right to cancel your Order and refund any money paid to us.

3.6. You acknowledge and agree that:

a) all pictures and images of Goods displayed are for illustrative purposes only;

b) any accessory featured with the Goods is for illustrative purposes only, and may be sold separately; and

c) where we provide dimensions and measurements in the description of a Good, the dimensions may vary slightly in real life, and it is your responsibility to ensure that the actual size of each Good is suitable for your purpose prior to submitting your Order.

4. Price and payment

4.1. When you place an Order, we will charge you and you agree to pay the Price and any applicable Delivery Fee.

4.2. All Prices are in Australian Dollars or your local currency, if GST applies, inclusive of GST. Any fees and charges (including Delivery Fees) imposed by these Terms also include GST where applicable.

4.3. We reserve the right to change or alter Prices without notice to you. If you have already submitted an Order at a particular Price, We will supply your Goods at that Price (unless your Order is affected by a pricing error, in which case clause 3.4 will apply).

4.4. Payment methods are specified on the Website. They may include credit card, PayPal, Afterpay, Allora Jade Gift Card or store credit. The name on any credit card used for payment must match the name on the Order. Cheques and Bank transfers cannot be used as a payment method for any purchase from the Site, including for the payment of Orders. If you pay using Afterpay, the Afterpay prevailing terms and conditions apply. View Afterpay terms at http://www.afterpay.com. Payment methods may be subject to change.

4.5. Any payment for an Order must be cleared by Allora Jade before Goods are dispatched. If your payment cannot be processed, your Order will be rejected and you will be notified of this. If a credit card payment cannot be processed you should contact your card issuer to try to resolve the problem, or use an alternative payment method in order to continue with your Order.

4.6. In paying or attempting to pay for Goods, you agree that you have not engaged in any fraudulent conduct or contravened any Law.

4.7. Lay-by is not available for Orders.

5. Delivery

5.1. Click here for delivery options and conditions.

5.2. Delivery timeframes are estimates only. Dispatch and delivery timeframes can depend on things like stock availability, delivery-service provider availability/delays and events beyond our control. Please note that during major sale events like Stocktake Sales, Mid-Season Sale and Black Friday, there may be a minor delay in preparing your order.

5.3. Your Order may be fulfilled from multiple locations at different times depending on stock availability. You won’t be charged any more for delivery in this instance.

5.4. If no-one is home when your delivery arrives, your driver will leave it in a safe place. If there is no safe place to leave the delivery, your driver will contact you via email, SMS or, if it's AusPost, the AusPost app with collection instructions. For AusPost deliveries, if your parcel has not successfully synced with your MyPost account, your delivery driver will leave a collection card.

6. Order cancellations and returns

6.1. Unless provided for under these Terms or as otherwise agreed by Allora Jade, no cancellations or changes to Orders will be accepted, and the Goods will be delivered to the Delivery Address in an Order. You should carefully check that your Order is accurate before you submit it. You will, however, be able to return Goods under the Returns Policy.

6.2. If we cannot contact you about your Order using the contact details you provided in the Order, after having made reasonable attempts to contact you, we will cancel your Order and refund any money paid to us in respect of your Order. We may, at its discretion, charge you a fee to cover Our administrative costs.

6.3. Unless otherwise explicitly stated by Us, Delivery Fees will not be refunded if you return Goods for change of mind or you made an incorrect selection, including if you ordered the incorrect size, colour etc.

6.4. Any Goods you purchase can only be returned in accordance with these Terms and the Returns Policy. The Returns Policy forms a part of these Terms.

6.5. Allora Jade will process any refunds within a reasonable time of agreeing to do so.

6.6. If the original payment was made:

a) on a credit card, refunds will be processed on the same card as the original payment was made.

b) by a combination of Allora Jade Gift Card and credit card then:

a. refunds will be processed on the same card as the original payment was made first.

b. Return card for remaining amount will be emailed to the email address entered at the time you placed your Order.

c) using Afterpay, refunds will be processed back to the account through Afterpay.

d) using a multi-tender of a gift card or store credit and AfterPay for an online purchase, the refund will be provided as store credit in the first instance and then AfterPay for any remaining balance (unless otherwise required by law)

7. Promotions and discounts

7.1. Discount or promotional or coupon code (Code) cannot be combined in one order.

7.2. You may receive online offers and promotions with your Order or emailed to you or available on the Site or advertised on our Social Media accounts. Some offers may include a promotional or coupon code (Code) for use when placing an Order. It is your responsibility to ensure that the Code is valid, and that you enter the Code at the time of placing an Order. The Code cannot be applied after you have submitted your Order. Separate terms may apply to the use of the Code. The Code may be specific to only certain orders or Goods on the Site. Any Code is non-transferable, cannot be posted on a forum or website and may not be used with other offers.

7.3. All references to times in promotions are based on the local time in Caloundra, Australia unless stated otherwise.

7.4. Buy 3 items and receive 1 Free item or 4th Free item promotion: the lowest priced item in your cart is always the Free item.  

8. Privacy

8.1. Personal Information, which you provide to us during the Order or through the Customer Service Centre including contact details, will be kept, used and disclosed by Us in accordance with Allora Jade’s Privacy Policy for the purpose of processing and delivering your Order. See Allora Jade’s Privacy Policy for further information on how to access or update your Personal Information.

8.2 .We may also collect (even if you do not register to the Website), and our third party providers of advertisements and content may collect, location and other information such as the URL or advertisement you came from or linked to, IP address, browser type, pages you visited from the Website etc.

8.3. Unless otherwise indicated in your account settings or at the time you placed your Order, Allora Jade may send you marketing information

8.4. If you wish to change or update your online account information (including your email address, password or communication preferences), simply login to your account. Alternatively you may contact our Customer Service Centre at enq@allorajade.com.au

8.5. Allora Jade reserves the right to conduct and implement fraud detection processes, including without limitation to validating your credit card details. If your nominated payment method triggers our fraud prevention protocols, we may contact you to confirm additional details, or rescind the transaction. In this case, your Order must pass our fraud prevention protocols before it will be fulfilled. If you do not provide the requested information within the required time frame, your Order will be cancelled and payment returned, if applicable, to the method you originally paid. These information requests are sent to help protect credit card holders from online fraud.

9. Errors, Inaccuracies and Omissions

9.1. Occasionally there may be information on our Site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).

9.2. We undertake no obligation to update, amend or clarify information in the Service or on any related Site, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related Site, should be taken to indicate that all information in the Service or on any related Site has been modified or updated.

10. Prohibited uses

10.1. In addition to other prohibitions as set forth in the Terms of Service, you are prohibited from using the site or its content:

a) for any unlawful purpose;

b) to solicit others to perform or participate in any unlawful acts;

c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances;

d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others;

e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability;

f) to submit false or misleading information;

g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet;

h) to collect or track the personal information of others;

i) to spam, phish, pharm, pretext, spider, crawl, or scrape;

j) for any obscene or immoral purpose; or

k) to interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet. We reserve the right to terminate your use of the Service or any related website for violating any of the prohibited uses.

11. Risk and Title to Goods 

11.1. Risk and title in the Goods passes to you on the date and time of delivery of the Goods to you by the Delivery Agent.

12. Disclaimer of Warranties; Limitations of Liability

12.1. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

12.2. We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free.

12.3. We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable.

12.4. You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.

12.5. You expressly agree that your use of, or inability to use, the service is at your sole risk.

12.6. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

12.7. In no case shall Allora Jade, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall not exceed the greater of one hundred Australian Dollars (AUD $100.00) or the amount you paid Allora Jade, if any, in the past six months for the product or service giving rise to the claim.

13. Indemnification

13.1. You agree to indemnify, defend and hold harmless Allora Jade and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

14. Severability

14.1. In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

15. Termination

15.1. The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

15.2. These Terms of Service are effective unless and until terminated by either you or us.

15.3. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

15.4. If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

16. Entire Agreement

16.1. The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

16.2. These Terms and any policies or operating rules posted by us on this site or in respect to the Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

16.3. Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.

17. Governing Law

17.1. These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of 1 Ormuz Ave, Caloundra QLD 4551, Australia.

18.2. We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website.

18.3. It is your responsibility to check our website periodically for changes.

18.4. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.
